ExitLog Terms of Service
ExitLog is a web-based recordkeeping product operated by Niktasoft (registered in Ontario, Canada). These terms are written for clarity and are not legal advice.
Agreement to Terms
By accessing or using ExitLog, you agree to these Terms of Service. If you are using ExitLog on behalf of an organization, you represent that you have authority to bind that organization to these terms.
Service Description
- ExitLog is a recordkeeping and reporting tool for storing inspection records, photos, and PDFs.
- ExitLog does not certify compliance, does not perform audits, and does not guarantee inspection readiness.
- ExitLog is not professional, legal, fire safety, or compliance advice.
User Responsibilities
- You are responsible for performing inspections and maintaining your own procedures.
- You are responsible for ensuring entries are accurate, complete, and submitted on time.
- You are responsible for any decisions you make based on information stored in ExitLog.
Accounts and Access
- You must provide accurate account information and keep it up to date.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us promptly if you suspect unauthorized access to your account.
Customer Content: Ownership and License
You retain ownership of the content you submit to ExitLog (including inspection logs, photos, and PDFs). You grant Niktasoft a limited license to host, store, process, and display that content solely to provide, secure, and improve the service and to support you.
Acceptable Use
- Do not attempt to access other customers' data.
- Do not interfere with the service, probe, scan, or test vulnerabilities without permission.
- Do not upload content that is illegal, infringes rights, or includes malware.
- Do not misuse the service in a way that could harm others or degrade availability.
Fees
Some features may require payment. If fees apply, you agree to pay the amounts shown at checkout or on your invoice, plus any applicable taxes. We may change pricing or plans from time to time with reasonable notice.
Disclaimer
- ExitLog is provided "as is" and "as available".
- We do not guarantee that ExitLog will be uninterrupted, error-free, or meet your requirements.
- We do not provide an audit, inspection, or compliance guarantee.
Limitation of Liability
To the fullest extent permitted by law, Niktasoft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill.
To the fullest extent permitted by law, Niktasoft's total liability for all claims related to ExitLog is capped at the amount you paid for ExitLog in the 12 months before the event giving rise to the claim. If you are using a free tier (or have paid nothing in that period), the cap is CAD $100.
Termination
- You may stop using ExitLog at any time.
- We may suspend or terminate access if you violate these terms or misuse the service.
- Upon termination, your access may be removed and your data may be deleted upon request, subject to backups.
Governing Law
These terms are governed by the laws of Ontario, Canada, without regard to conflict of laws principles.
